Terms and Conditions

Welcome to TheStampO. These Terms and Conditions ("Terms") govern your access to and use of the TheStampO mobile application (available on Android and iOS) and related services (collectively, the "Platform" or "Services"), operated by Kunatic, the sole proprietorship of Kunal Biswas ("TheStampO," "we," "us," or "our").

By creating an account, accessing, or using the Platform in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

1. About TheStampO

TheStampO is a mobile application that turns your photos into collectible, stamp-style keepsakes, with optional location tagging, collection organisation, streak tracking, and reminders.

2. Eligibility

You must be at least 13 years of age to create an account or use the Platform. We reserve the right to refuse, suspend, or terminate accounts at our sole discretion.

3. Account and Sign-In

You can create a TheStampO account only through Sign in with Google or Sign in with Apple (Apple sign-in is available on iOS). The app does not offer a separate sign-up form. When you use either option, you authenticate directly with Google or Apple, and your use of that sign-in service is also subject to their respective terms and privacy policies. We never receive your Google or Apple password.

After your account is created, you may optionally set a password in the app (Account → Change password). You can then also log in with your account email address and that password. You can change your account email address and password, and reset a forgotten password through the "Forgot password?" link, at any time.

You are responsible for keeping your Google or Apple account and any TheStampO password secure, for not sharing your password, and for all activity under your TheStampO account. Notify us immediately at thestampoapp@gmail.com of any unauthorised use.

When you first open the app, a temporary session is created automatically so the app can work before you sign in. This temporary session is not a registered account. Your TheStampO account is tied to the Google or Apple account you signed up with, so use the same one (or your email and password, if you set one) to get your stamps back later.

4. How the Service Works

You capture a photo with your camera or select one from your photo gallery, and TheStampO converts it into a stamp in your collection. You may optionally tag a stamp with your approximate location by tapping the location button; this happens only when you explicitly request it.

Your stamps and collections are stored on your device. While you are signed in, they are also automatically backed up to our cloud storage in the background, so they can be restored if you reinstall the app or sign in on another device. You may export stamps to your photo gallery or share them where the feature is available.

Cloud backup requires an internet connection. Although we take care to protect your data, we recommend exporting stamps you especially value, as we cannot guarantee that a backup will always be complete or available.

5. Payments and Fees

The app is currently offered free of charge. We do not currently display advertisements or offer in-app purchases. If paid features or subscriptions are introduced in a future version, all fees will be clearly disclosed before you confirm a purchase, and payments will be processed through the applicable app store's billing system (Google Play or Apple App Store). We do not store your payment card details. Cancellations and refunds for any future paid features will be governed by the terms disclosed at purchase, the applicable app store's policies, and applicable law, including the Consumer Protection Act, 2019.

6. User Conduct

By using the Platform, you agree that you will NOT:

• Use the Platform to create or store content that is unlawful, obscene, defamatory, or infringing, or that depicts or exploits minors;
• Upload photos of other people in a way that violates their privacy or rights;
• Use the Platform for any unlawful purpose;
• Attempt to bypass, reverse-engineer, decompile, or interfere with the Platform's systems, or access another user's data;
• Share, sell, or transfer your account to another person;
• Use automated means to access or overload the Platform.

We reserve the right to suspend or permanently remove any account, and to delete any content, that violates these standards.

7. Intellectual Property

All content, branding, trademarks, logos, stamp designs, and software associated with TheStampO are the property of Kunatic or its licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.

8. Your Content

Any photos, notes, or other content you add ("Your Content") remains yours. You confirm that you have the right to use Your Content, and that it does not infringe the rights of any third party. You grant us a limited licence to store, back up, process, and display Your Content solely to provide the Services to you. We do not use Your Content for advertising, and we do not publish or share it with other users.

9. Platform Availability

The Platform is provided on the Google Play Store (Android) and the Apple App Store (iOS). We do not guarantee uninterrupted or error-free access and may modify, suspend, or discontinue any part of the Service at any time.

10. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, TheStampO and Kunatic shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or loss of access to your collection. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

11. Indemnity

You agree to indemnify and hold harmless TheStampO, Kunatic, and their representatives from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Platform.

12. Termination and Account Deletion

You may stop using the Platform at any time. You can permanently delete your account directly in the app (Account → Delete account). This deletes your account and your cloud-backed-up stamps and collections from our systems, as described in our Privacy Policy. Stamps stored on your device or saved to your photo gallery are not removed by account deletion.

We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. Sections 7, 10, 11, 13, and 14 survive termination.

13. Apple App Store Terms

If you downloaded the app from the Apple App Store, you also acknowledge that:

• These Terms are between you and Kunatic only, not Apple, and Kunatic (not Apple) is solely responsible for the app and its content;
• Apple has no obligation to provide any maintenance or support for the app;
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app;
• Kunatic, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, and intellectual property infringement claims;
• You are not located in a country subject to a U.S. Government embargo, and you are not on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, India.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the app or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.
